Terms and Conditions

I. CONTEST DESCRIPTION:

"Jio Bigg Boss” is a skill based online quiz game and can be played on MyJio (hereinafter defined) or JioCinema (hereinafter defined).

II. DEFINITIONS:

For the purposes of these Terms and Conditions, the expressions used as shown herein-under shall have the meaning ascribed to them as shown herein-below:

“Company” means Reliance Industries Limited (“RIL”) and/or any of its affiliates or associates as RIL may nominate from time to time. The expression “Company” shall also mean and include Vibrant Advertising Private Limited, who is authorised to act as the event manager of Jio Bigg Boss and enter into necessary contracts in its own name for sponsorship, advertising and other promotional matters pertaining thereto;
“Episode” means an episode of the Show ;
“MyJio” means the application where Jio Bigg Boss will be accessible from;
“JioCinema” means the application where Jio Bigg Boss will be accessible from;
“Participant(s)” means any person(s) who registers and / or participates in Jio Bigg Boss and who (i) is above eighteen (18) years of age as on the date of participation; (ii) is a citizen of India residing in India (iii) is of sound mind and health and (iv) agrees to enter into and participate in Jio Bigg Boss in accordance with the Terms and Conditions as defined in this document.
“Producer” means the producer of the Show which is Colors TV Network;
“Prize(s)” shall mean any or all prize(s) won by Participants;
“Terms and Conditions” means these terms and conditions governing the Jio Bigg Boss, as stated herein in entirety and as may be amended by the Company from time to time;
"Show" means the program titled Bigg Boss– Season [12] (“Bigg Boss”) being produced by the Producer for initial exhibition on Colors TV Network (“Colors”);
“Winner(s)” shall mean any winner(s) as may be determined by the Company from time to time, which shall be governed by these Terms and Conditions.

III. PROCEDURE TO PARTICIPATE IN THE JIO BIG BOSS:

1. Participation

The Participant should participate in Jio Bigg Boss by registering on MyJio. and/or on JioCinema. The game will be available on MyJio from September 26, 2018 to till the end of the Show and on JioCinema from November 1, 2018 to till the end of the Show (“Game Period”).
The schedule mentioned in Clause III (1) (a) above could be added to, modified or cancelled based on programming/ technical requirements and in the event the Show is for any reason rescheduled, extended, cancelled or terminated early.
The mobile phone number from which the registration is received will be used to identify the Participant as a unique identification number. We urge Participants to use numbers where they would be clearly identified as the Participant of Jio Bigg Boss.
Any entry for participation in Jio Bigg Boss is not transferrable.
The failure to provide proof or affidavit of eligibility, including the proof of name, address and correct date of birth within the time as stipulated in the Terms and Conditions or upon request by the Company may result in disqualification. The Company also reserves the right to disqualify a Participants in case where a discrepancy is found to exist in the information furnished/provided/stated by the Participant during the conversation with the Company or any of the Company’s sub-contractors and vendors in Jio Bigg Boss, and/or in the information stated in the documents furnished by the Participant or at any time.
The Participant may be required to furnish necessary supporting documentation as proof of age, address, name, photo identity and nationality i.e. one original and attested photocopies of either (i) passport/driving license or (ii) PAN Card along with birth certificate and ration card or (iii) voter identity card with birth certificate (iv) UID/Aadhar Card.
The Company may, at its discretion, contact the Participant(s), if required, for any clarifications needed for the information provided when contacted by the Company.
The Company has the right at any time to require proof of identity and/or eligibility. Notwithstanding any such request being made by the Company, the failure to provide such proof within the timelines as may be stipulated by the Company under the Terms and Conditions or from time to time, could result in disqualification from Jio Bigg Boss.
All personal details and information requested by and supplied to the Company by each Participant must be truthful, accurate and in no way misleading. The Company reserves the right to disqualify any Participant (s) from Jio Bigg Boss at its sole discretion, should the Participant(s) at any stage supply untruthful, inaccurate or misleading personal details and/or information.

2. Registration

Download the MyJio or JioCinema from the app store for iOS or play store for android..
Participants can share the link to play Jio Bigg Boss with phone contacts. The recipient can select the link for download to access the MyJio or JioCinema and commence the registration process.
For registration through MyJio only- Participant(s), who are not subscribers of telecommunication services of Reliance Jio Infocomm Limited (“RJIL”) (“Jio Subscribers,”), will have to verify their mobile number by confirming the OTP received on their mobile number. After confirming the mobile number, the Participant will have to click on ‘Jio Bigg Boss” tab to start playing Jio Bigg Boss. Such Participants cannot proceed without confirmation of their mobile number. Please note that the Company will be able to get in touch with the Participants, if needed, only if the Participants have furnished a mobile number that is registered with a telecommunication service provider in India. The Participants hereby acknowledge and agree that the Company shall be entitled to, for the purposes of Jio Bigg Boss, receive the contact information of the Participant(s) from MyJio.
For Jio Subscribers- Participant (s), who are Jio Subscribers, may directly open MyJio or JioCinema and click on ‘Jio Bigg Boss” tab or open Jio Games tab in MyJio and click on “Jio Bigg Boss Contest” tab, to start playing Jio Bigg Boss. The Participant (s) agree and acknowledge that RJIL shall share the mobile number information with the Company to get in touch with the Participants.
Participant(s) to provide confirmation with regards to the age eligibility, citizenship and acceptance of Terms and Conditions.
Participants should click on the “Bigg Boss” banner on the homepage of MyJio or JioCinema to participate in Jio Bigg Boss. After clicking on the “Bigg Boss” banner the Participant should click on “Let’s Play”. Upon clicking “Let’s Play”, the Participant should answer the questions on the profile page to create their profile.
In the event the Participant uses a SIM card not registered in his name for registration, the Company will not be responsible to track such Participant(s).
In the event it is not possible to determine with certainty the person who registered from a particular mobile phone number, that entry would be disqualified. Participant(s) are requested to use mobile phone numbers which are unique to them.
Taking part in the registration process shall be deemed to be acceptance by the Participant(s) to receive promotional messages from the Company or any third party so authorized by the Company.
The procedures for registration and participation in Jio Bigg Boss are subject to the Terms and Conditions stated herein. Non-conformance by any Participant(s) to the Terms and Conditions will disqualify him/her from participation or winnings, immediately, as the case may be.
Profile photograph shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third party.

3. Charges for Jio Bigg Boss

Downloading MyJio or JioCinema and playing Jio Bigg Boss is free of cost, however data charges may apply. For further details please contact your telecom operator
Please check with your telecom operator for any other applicable charges. In case any user registers while roaming in a different circle/zone/country, additional roaming rates may apply. Please contact your telecom operator for the applicable rates.

4. Playing Rules

a. Polls:

Commencing at 10:00 PM IST every day during the Game Period, the Participants shall be entitled to answer poll questions for such duration as may be determined by the Company not exceeding 24 hours.
The answers provided by a Participant during the poll will be matched against identical answers provided by all other Participants to ascertain the number of identical answers offered by all Participants. The quantum of identical answers offered across Participants for any poll (in percentage) shall be published in the form of poll results by the Company from time to time.
For every poll answered by the Participant, whether or not such answer matches the outcome of the poll, the Participant will be awarded 10 points.
The Participants will be able to see the poll results immediately after the Participant answers the poll.
No extra points will be awarded to the Participant if his/her opinion matches with the outcome of the poll.
Post submission of the answer, the Participant(s) will not be permitted to modify / alter / change the answer submitted.
The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of Jio Bigg Boss.
The Company shall not be responsible in any manner whatsoever for the poll questions and poll results, including but not limited to the appropriateness, manner of depiction, timing and accuracy thereof.

b. Nominations:

During the Game Period, every week between every Sunday 11pm to Monday 9pm, a Participant may vote on MyJio/ JioCinema for one contestant of the Show who according to the Participant should get nominated that particular week for eliminations and such Participant shall be awarded 10 points for such voting.
Post submission of the answer, the Participant(s) will not be permitted to modify / alter / change the answer submitted.
The Participant acknowledges and agrees that the voting for the purposes of Jio Bigg Boss and voting for the purposes of the Show are separate and distinct voting processes. Any voting by a Participant in Jio Bigg Boss shall not be construed as voting for the Show and vice versa.
If the contestant who was voted by the Participant gets nominated for the eliminations in the Show in the preceding week between Monday to Wednesday, such Participant will be awarded 2X points.

c. Elimination:

During the Game Period i.e., every week between Tuesday 10pm to Friday 9pm, a Participant may vote on MyJioMyJioJio / JioCinema for one contestant who according to such Participant should get eliminated that particular week and such Participant shall be awarded 10 points for such voting.
Post submission of the answer, the Participant(s) will not be permitted to modify / alter / change the answer submitted.
The Participant acknowledges and agrees that the voting for the purposes of Jio Bigg Boss and voting for the purposes of the Show are separate and distinct voting processes. Any voting by a Participant in Jio Bigg Boss shall not be construed as voting for the Show and vice versa.
If the contestant who was voted by the Participant gets eliminated in the Show on the preceding Sunday, such Participant shall be awarded 2X points and the Eliminator Prize (herein after defined) .

d. Favorites:

During the Game Period, every week on Sunday 11pm to Tuesday 9pm, the Participants shall select three (3) contestants as favorites.
If one of the contestants that a Participant chooses as his/her favorite for a particular week, becomes the captain of the Show for that week, then such Participant shall be awarded 100 points.
If one of the contestants that a Participant chooses as his/her favorites for a particular week, is the member of a team which wins the weekly tasks for that particular week, then such Participant shall be awarded 50 points.

e. Quiz up:

1. Daily Dose

The Participant will get to play a daily quiz from 10:00 PM everyday till 10:00 PM the next day (“Daily Dose”).
For each correct answer by the Participant in the Daily Dose, the Participant will be awarded 50 points.
Post submission of the answer, the Participant(s) will not be permitted to modify / alter / change the answer submitted.
The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of Jio Bigg Boss.
The Company shall not be responsible in any manner whatsoever for the questions and the results, including but not limited to the appropriateness, manner of depiction, timing and accuracy thereof.

2. Weekend ka Extraa Dose

The Participant will get to play weekly quiz from 10:00 PM on Friday till 09:00 PM on Monday, of every week (“Weekend ka Extraa Dose”).
For each correct answer by the Participant in the Weekend ka Extraa Dose, the Participant will be awarded 50 points.
Post submission of the answer or on expiry of the allotted quiz time, the Participant(s) will not be permitted to answer/ modify / alter / change the answer submitted.
If the Participant pauses the quiz up due to any reason including but not limited to minimizing or closing the application, the quiz up will start from beginning of such quiz, if the Participant resumes Jio Bigg Boss thereafter.
Points will be awarded to the Participant only upon the completion of the entire daily quiz or weekly quiz.
The Company will not entertain any claims / questions / queries with respect to the authenticity or correctness of any questions and answers for the questions asked in any round of Jio Bigg Boss.
The Company shall not be responsible in any manner whatsoever for the questions and the results, including but not limited to the appropriateness, manner of depiction, timing and accuracy thereof.

5. Winner Selection

The Company may, at its discretion, decide to award Prize(s) to a Winner as the Company deems fit and Prize(s) so won shall be announced by the Company at its sole discretion. Every Episode may not have Prize(s).
Where more than one Participant scores the same highest number of points, the Winner(s) will be determined with the help of randomizer software developed specifically for the purpose of selection of the Winner(s). The randomizer will use an appropriate method of selecting winners to break the tie, at the discretion of Company. In the event of a software failure, or for any other reason, the Company may adopt any other methodology or criteria at its sole discretion to select from amongst the Participants, depending upon requirement and availability of time.
The Company will rely upon only such telephonic contact information as may be provided by the Winner at the time of participation in Jio Bigg Boss (or registration on MyJio) to contact him/her.
Where the Winner(s) cannot be contacted telephonically; or (ii) after being so contacted (maximum of 3 (three) attempts), the Winner(s) does not claim the Prize with sufficient proof of identification as such Winner(s); the Prize for such Winner(s) stands forfeited and the next Participant who has scored the same highest number of points will be selected as the Episode Winner(s). No further claims by the original Winner who could not be contacted or does not claim the Prize, will be entertained and the Company will not be responsible or liable in any way whatsoever to such persons.
Notwithstanding the foregoing, the Company reserves the rights to determine and/or announce the timelines and the methodology of determining Winners from time to time.

6. Prizes

a. Profile completion:

On completing the user profile in Jio Bigg Boss, the Participant (s) shall be rewarded with a unique electronic coupon code of AJIO worth Rs. 500/- (Rupees Five Hundred only), subject to such terms and conditions as stipulated in Annexure-A (“Profile Completion Prize”).

b. Daily Winner:

On winning the live quiz of Jio Bigg Boss, such Participant (s) who are chosen as the Winner by the Company, shall be rewarded with a unique electronic coupon code worth Rs. 700/- (Rupees Seven Hundred only), subject to such terms and conditions as stipulated in Annexure-A (“Daily Winner Prize”).

c. Weekly Winner:

On winning the live quiz of Jio Bigg Boss for a given week, such Participant (s) who are chosen as the Winner of that particular week by the Company, will be rewarded with a unique electronic coupon code worth Rs. 1000/- (Rupees One Thousand only), subject to such terms and conditions as stipulated in Annexure-A (“Weekly Winner Prize”).

d. Season Winner:

On winning the live quiz of Jio Bigg Boss for the entire season of the Show, such Participant (s) who are chosen as the Winner of the season by the Company, shall be rewarded with a unique electronic coupon code worth Rs. [ ], subject to such terms and conditions as stipulated in Annexure-A (“Season Winner Prize”).

e. Eliminator Winner:

If the contestant who was voted by the Participant gets eliminated in the Show on the preceding Sunday, such Participant shall be rewarded with a unique electronic coupon code worth Rs. 900/-, subject to the terms and conditions as stipulated in Annexure-A (“Eliminator Winner Prize”).

7. Winner Declaration and Pay-out / Prize(s) handover

The Company reserves the right, at its discretion, to institute one or more Prize(s) for Jio Bigg Boss and the terms and conditions attendant thereto, including whether such Prize(s) are daily, weekly, grand, cumulative, non-cumulative or any combination thereof. Every Episode may not have Prize(s).
The Company reserves the right to offer or withdraw any of the Prize(s) as provided herein-under, at any point of time, including after they have been announced.
The Participant hereby acknowledges and agrees that any voting by the Participant on Jio Bigg Boss shall have no nexus, bearing, relationship or association of any kind whatsoever with the live voting of the Show.
The Participant hereby further acknowledges and agrees that the points awarded to the Participant under the Jio Bigg Boss are merely a notional representation of the performance of the Participant in Jio Bigg Boss in terms of score, and as such, are neither en-cashable, transferable nor convertible in any manner, for any prize, benefit, emolument or reward of whatsoever nature.
The Company shall have the liberty but not the obligation to publish information with respect to the top points scored by the Participants in Jio Bigg Boss conducted from time to time (“Leader Board”). The Leader Board is indicative only, and may not be up to date across all Participants and the Leader Board data cannot be used as evidence in any manner.
The Company may, in its sole discretion, exclude a Participant from participating in any part of Jio Bigg Boss which may include without limitation (i) circumstances which, in the Company's view, renders the Participant unfit to participate therein; (ii) inability to produce documentation specified by the Company proving the identity of the Participant; (iii) any other reason that, at the discretion of Company, would adversely impact the Company or Jio Bigg Boss. At no point of time will the Company be obliged to notify unsuccessful Participants of its decision.
Company will use the number used to register on MyJio or JioCinema by the Participant to identify the Winner of the Prize(s) won, if any. Inability on the part of the Participant to accordingly show or provide the required identification proof could entitle the Company to disqualify the Participant from any winnings, if any.
Participant (s) participating through JioCinema hereby acknowledge and agree that they will receive Prize(s) in “My Coupons” section on MyJio and that such Participant (s) will have to download MyJio to redeem such Prize (s). The Participant (s) hereby consent to the Company sharing the registration information with MyJio for availing such Prize (s).
Whilst the Company and/or Producer, as the case may be, shall make all reasonable endeavors to (i) enable Participant(s) to proceed with participation in Jio Bigg Boss (ii) to contact all Winner(s), neither the Company nor the Producer can guarantee contact and the Company and/or the Producer, as the case may be, shall, at its sole discretion, be entitled to proceed with the next entitled Participants who are eligible to be Winners under the Terms and Conditions, in case it is unable to successfully contact and communicate with Participant(s)/ Winner(s) in terms hereof.
The Company will have no liability to a Participant who is unable to take part in Jio Bigg Boss for whatever reason and the Company shall be entitled to disqualify the Participant(s) from Jio Bigg Boss at any time, at the discretion of the Company.
The Company further reserves the right to replace at its discretion any Winner(s) who for any reason fails or is disqualified from or unable to participate in Jio Bigg Boss with another Participant who has scored the same number of points and is otherwise eligible to be a Winner, notwithstanding that such Participant may have been previously eliminated from Jio Bigg Boss and each Participant shall agree to collect the Prize(s) as and when required by the Company to do so.
If at any point it is determined by the Company that any person has tampered with MyJio, Jio Bigg Boss, or any data / servers / database / etc. related to Jio Bigg Boss, the Company reserves the right at its discretion to revoke or cancel points or winnings of any such Participant and / or initiate litigation as deemed fit and necessary by the Company.
Any and all taxes and/or levies applicable on the Prize(s) won by the Winner(s) under the laws of India shall be borne by the Winner(s) and/or relevant sponsors in relation to the relevant Prize(s). The Prize(s) to the Winner(s) shall be subject to deduction of all applicable taxes and levies and subject to the relevant Winner(s) providing the relevant documents as may be prescribed by the Company and/or relevant sponsor and subject to the Winner’s adherence to the applicable conditions, including special conditions, for the purposes of availing the Prize(s).
The delivery of any Prize(s), including the terms and conditions applicable thereto, shall be determined by the Company. The Company will not be responsible should the Winner(s) refuse to accept and/or be unavailable or incapacitated in any manner whatsoever to accept the Prize(s) as made available.
The Winner agrees that the delivery of his/her relevant Prize(s) may be delayed as a result of a delay in submission of documents and/ or any force majeure events which are not within the control of the Company and/or the Producer.
The Winner hereby agrees that he/ she shall not hold the Company responsible for any delays and/ or disputes and/or claims arising out of any Prize(s) that such Winner may be entitled to, and shall indemnify the Company against any and all such claims.
The Winner hereby agree that any in case of any disputes/ claims arising out of any Prize(s), the same shall be addressed directly to the relevant sponsor of such Prize(s) and the Company shall not be held responsible for the same.
The Company may refuse to pay winnings or reclaim all sums paid to Winners in the event of any fraud, dishonesty or non-entitlement on the part of any of such Winner(s) to participate in Jio Bigg Boss under the Terms and Conditions.

8. Special Conditions for Prizes

With respect to the Prizes, the special conditions applicable, if any, as notified by the relevant sponsor to the Company, is provided in Annexure A hereto. The Company shall make reasonable endeavors to communicate at Annexure A, such special conditions as may be notified to it by the relevant sponsors from time to time. However, the Company does not guarantee or assure the completeness and accuracy of such special conditions, including any updation or revision thereof from time to time and it shall be the sole responsibility of the relevant Winner(s) to ascertain all conditions pertaining to the Prize won by such Winner directly with the relevant sponsor.
The Company shall not be, in any manner, responsible for any decision taken by a Winner to avail any Prize and any consequences arising from the conditions that may be imposed by the relevant sponsors upon such Winner(s).
In the case of any conflict between any of the special conditions laid out in Annexure A and these Terms and Conditions, the latter shall take precedence and prevail.

IV. SYSTEMS AND AVAILABILITY

The Company will not be responsible for any break or disconnection or disruption in network connectivity in any manner, irrespective of the network being used. Network issues can disrupt various aspects of Jio Bigg Boss such as receipt of questions and answer options, receipt of any sound, text, image or audio files related to the question, receipt of answer chosen by the Participant, etc. The Participant is advised to remain in an area with a strong and stable/ continuous mobile network signal of the telecom operator or internet service provider to ensure smooth functioning of Jio Bigg Boss.
Any loss or outrage or dissatisfaction suffered by the course of playing Jio Bigg Boss by a Participant would not be the responsibility of the Company and/or its associates/ affiliates and the Company or its associates/affiliates will not be responsible to make good any such loss or dissatisfaction.
All attempts will be made to protect the data from loss and corruption, but in the event such data loss happens, Company may have to continue with whatever data is available, or in any other manner as it may deem reasonable. The Company should not be held responsible for any loss of data or the action taken on account of the same. The Company will not be held responsible to make good any such loss or dissatisfaction on account of such loss.
In the event the response of the Participant is not for any reason received within the stipulated time period for the question, such Participant would be not be able to get points in the event that question(s) was correctly answered by the Participant. The Participant can continue to answer questions once re-connected to the Jio Bigg Boss server(s). Company or its vendors and partners are not responsible for any such instances.
In case multiple entries are received from a Participant for the same question, Company has the right to choose the first entry received from that Participant. If multiple entries are received at the same time, then the Company will chose any of the answer entries received. Scores calculated basis this will be considered final and would be updated on Jio Bigg Boss subsequently at a later date.
Prior to start of play of Jio Bigg Boss, the Participant must check that MyJio is operational and functioning correctly. The Participant is advised to keep adequate RAM and phone memory available to ensure smooth functioning of Jio Bigg Boss. Quitting other applications on the device will also help towards smoother gameplay in case of some phones. The Participant is advised to keep the device from which Jio Bigg Boss is played, adequately charged. Low battery will result in shut down of the network and / or device and that will result in the Participant not being in a position to play quiz up during the live telecast of the Show.
The server used to communicate with the Participant has adequate redundancies built into it. However, in the rare cases, the server is down during the Game Period, the Company will, at its discretion but not as an obligation, determine such measures as it may deem fit, including cancelling certain sections or segments or question(s) from being scored and/or awarding points to all the Participants for that section, or any other means at the discretion of the Company.
This is the first time such a contest is being conducted for the Show. Accordingly, the Participant acknowledges that all possible issues may not have been identified by the Company and its partners, and agrees to hold harmless the Company and its partners for the application, network, process, technical or any other failures. Any losses, injury, discomfort, loss of privacy, inability to participate or any other discomfort of any sort caused to the Participant or the Participant’s property or device shall not be the responsibility of the Company or its partners.
No grievance by any person (i.e., either the Participant, or any person on behalf of the Participant) against the Company or its partners, shall be entertained unless the same is by way of a written complaint made to jioplayalong@jio.com and the Company shall, at all times, be accorded a reasonable opportunity to address the complaint. In any case, no grievances of any nature whatsoever shall be entertained by the Company beyond 30 (thirty) days after the completion of Jio Bigg Boss.
In case any unauthorized activity is observed on Jio Bigg Boss, that particular Participant will be disqualified to play till such time as the Company deems fit. The Company would not be responsible in any manner whatsoever on account of such disqualification.
Company shall not be liable for any failure of the application server or system in the course of playing Jio Bigg Boss.
The Company shall endeavor to make all reasonably practicable arrangements, it cannot guarantee or assure seamless connectivity or continuous availability of the application, server, system or software to the Participants during the conduct of Jio Bigg Boss as these are dependent on external utilities/ service providers and factors which could be beyond control of the Company.
Company and its sub-contractors are not responsible for delayed receipt or non-receipt or incomplete receipt or corrupt receipt of answers
The Company accepts no liability and shall not be responsible and/or liable in any manner whatsoever in case the Participant(s) are unable to participate in Jio Bigg Boss due to failure on the part of the telecom operator, facility provider, etc., or due to capacity constraints.
It shall not be open for the Participant(s) or any of their representatives to require an audit or verification of the randomizer/ selection software or any other criteria, process or system adopted by the Company as part of the process of conduct of Jio Bigg Boss or selection of Winners resulting therefrom.
No enquiries, appeals, verbal or written, shall be entertained in this regard.

V. CONFIDENTIALITY AND PUBLICITY

The Company shall keep all the information (including sensitive personal information) collected from the Participants confidential and shall not share the information so collected with any party, save and except for the purposes of Jio Bigg Boss. The Participants hereby agree that the Company may share the information so collected with any third party only for the purposes of Jio Bigg Boss in an anonymised manner. Any information shared by the Participant to the Company shall be handled by the Company in terms of the privacy policy of the Company available at https://www.jio.com/en-in/privacy-policy.
None of the Participants shall, without the prior written approval of the Company, speak to the press or any other media or any third person, nor give any interviews or comments relating to any aspect of Jio Bigg Boss. The Participant shall not disclose any information whatsoever relating to the Company to any other party. Violation of this clause shall immediately disqualify the Participant’s prospects of further participation.
The Participant shall at all times keep confidential all particulars and details regarding Jio Bigg Boss.
As part of Participant’s contribution to Jio Bigg Boss, the Producer of the Show may request one or more Participant to participate in any online/interactive activity relating to the Show, including without limitation, the recordings of web-casts, interviews and participation in so-called ‘chat-rooms’. It is a further condition of entry and participation in Jio Bigg Boss that the Participant(s) shall adhere to and where necessary, procure from any and all contributors thereto, their necessary agreement and execution of the release form as devised from time to time by the Company and/or the producer of the Show.
The Winner(s) of Jio Bigg Boss as announced by the Company from time to time, agrees that he/she shall make himself/herself available from time to time and co-operate with the Company and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner(s). Further, the Winner(s)/ Participant(s) shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever if required by the Company. The Winner(s)/ Participant(s) agrees that the footage of any nature shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
Any photographs, videos etc. submitted by the Participants/Winners to the Company or recorded, shall on submission / creation become the property of the Company and shall be available to the Company for exploitation throughout the world in perpetuity. The Participant(s) shall ensure that the photos or videos submitted by them in any public domain or their performances shall not be obscene, vulgar, defaming, denigrating women or children, hurting religious sentiments, depicting violence or shall not infringe the rights of a third person. The Participant(s) shall solely remain liable for any action (criminal/civil) arising therefrom.
Acceptance of these Terms and Conditions by the Participant constitutes permission for the Company, including its affiliates, to click photographs, record videos of the Participant(s) and use the Participant’s name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.

VI. GENERAL TERMS AND CONDITIONS

The participation in Jio Bigg Boss(s) shall be considered to be acceptance of these Terms and Regulations.
The Participant hereby represents that he/she is not under any exclusive contracts with any other third party/ agency or is not under any kind of disqualification under law to enter into an agreement with the Company or its affiliates, as the case may be.
The Participant shall undertake, warrant and guarantee to the Company that the Participant has the full legal capacity to participate in Jio Bigg Boss in accordance with these Terms and Conditions.
The Participant acknowledges that he/she has voluntarily chosen to participate in Jio Bigg Boss at his / her free-will and is willing to bear all risk, costs & consequences arising from such participation in Jio Bigg Boss.
The Participant shall not have any claim against the Company and/or any of its affiliates connected with Jio Bigg Boss for the same. The Company or any of the affiliates connected with Jio Bigg Boss shall not be responsible for any such eventuality and the Participant(s) shall not be entitled to claim any compensation from the Company or the Producer of the Show.
In the event of any fault, misunderstanding or dispute concerning any part of Jio Bigg Boss, and/or the operation of the telephone system, the selection of Winner at any stage, or the validity of any question or answer options, the decision of the Company shall be final and binding on all Participant(s) and other persons. The Company is empowered to take a decision on any case or instances not covered by the present Terms and Conditions.
The Company reserves the right to amend (add, delete or modify) the Terms and Conditions prospectively or retrospectively, at its discretion and without prior notice, in order to improve Jio Bigg Boss or remedy any issues that occur.
The Company has the right at any time to terminate Jio Bigg Boss without any prior intimation or notice to the public and also the Company is not obligated in any manner whatsoever to compensate any person or persons who have participated in Jio Bigg Boss.
Registration or participation in Jio Bigg Boss does not guarantee a Prize(s) or award.
If the operation of Jio Bigg Boss; the recording or broadcast of any/all of the Show is prevented by an event of force majeure or otherwise, the Company may cancel all or any part of Jio Bigg Boss, or take such other decision as it deems fit.
In case the Winner(s) is found to be in violation of any and all rules/process of Jio Bigg Boss, the Company reserves the right to initiate legal proceedings against such person(s) including but not limited to having the concerned Winner to refund the Prize(s) money together with penalty interest as deemed fit by the Company. If at any time, including after disbursement of Prize(s), any information submitted by the Participant(s) is found to be incorrect, false, or otherwise misrepresented or misleading, the Participant(s) shall be liable to refund all amounts received from the Company/ the Company is liable to reclaim the Prize(s) from the Participant(s).
If any provision of these Terms and Conditions is held by any court or other competent authority to be void or unenforceable in whole or part, the other provisions of these Terms and Conditions and the remainder of the affected provisions shall continue to be valid.
These Terms and Conditions and Jio Bigg Boss shall be governed by and construed in accordance with the laws of India and the Participant(s) submit irrevocably to the jurisdiction of the Courts in Mumbai
The Company is empowered to take a decision on any case not covered by the present Terms and Conditions.
The Company is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any physical injury, death, mental trauma caused to any Participant(s) and/or the Winner (s) in any manner whatsoever, in relation to Jio Bigg Boss and/or Prize(s).
The Winner(s) and/or the Participant(s) of Jio Bigg Boss agrees that he/she shall hold harmless the Company, its employees, officers, sub-contractors or any other person in connection with the Prize(s) won by him/her and/or in relation to Jio Bigg Boss/Show including but not limited to the procedure in Jio Bigg Boss and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against sponsor and/or the Company to claim any damages or reliefs.
The Company or any of its affiliates will not be liable for any loss of earnings, employment or otherwise caused to the Participant(s) and arising as a result of his/her participation in Jio Bigg Boss.
The Participant(s) hereby agree to indemnify the Company or its affiliates against any claims that might arise from their actions or omissions while participating in Jio Bigg Boss.
The only way to enter Jio Bigg Boss is through participation as described in Terms and Conditions. There is no other way of entering Jio Bigg Boss. Any person claiming that he/she can help get you wins for a consideration is defrauding you. Please contact your local police and report this person immediately.

ANNEXURE-A

Special Conditions for Prize(s) sponsored by AJIO

The Profile Completion Prize can be redeemed only once by a Winner on or before 1st March 2019 on a minimum cart value of Rs. 1,290/-. The Prize cannot be availed on tech and innerwear products.
The Daily Winner Prize can be redeemed only once by such Winner on or before 1st March 2019 on a minimum cart value of Rs. 1,700/-. The Prize cannot be availed on tech and innerwear products.
The Weekly Winner Prize can be redeemed only once by such Winner on or before 1st March 2019 on a minimum cart value of Rs. 2,190/-. The Prize cannot be availed on tech and innerwear products.
The Eliminator Winner Prize can be redeemed only once by a such Winner on or before 1st March 2019, on a minimum cart value of Rs.1,999/-. The Prize cannot be availed on tech and innerwear products
The Winner (s) for (a) Profile Completion Prize; (b) Daily Winner Prize; (c) Weekly Winner Prize; and (d) Eliminator Winner Prize can avail a maximum discount of 55% on the maximum retail price of the selected products by redeeming the respective Prize (either independently, or together with other discounts available on the online platform of the sponsor).
Each Prize cannot be transferred or exchanged or replaced by any other prize and cannot be encashed.
Save and except the ability to determine a Winner, the Company is not responsible or liable in any manner whatsoever for all matters relating to Prize (s) including availability, eligibility, delivery or any other matters relating thereto or arising therefrom and AJIO only shall be solely responsible and liable therefor.
