TERMS AND CONDITIONS FOR FUN ZONE

1. SCOPE:

1.1 This application known as “Fun Zone” (“Application”) is an infotainment and gaming application, provided by Jio Platforms Limited (“Company”, “we” or “us”), located at Office-101, Saffron, Near Centre Point, Panchwati 5 Rasta, Ambawadi Ahmedabad, Gujarat 380006 IN.
1.2 The Application can be accessed through JioEngage on MyJio application (“Platform”) on your smart phone device powered by Android or iOS; (“Device”) starting 20^th June, 2020.
1.3 The Application provides to its users, the following services: (i) infotainment content; (ii) trivia quiz; (iii) polls and votes; and (iv) daily challenges; based on the theme of the day as more specifically described under Annexure A; (v) skill based games and engagements; and (vi) any other service as may be provided by the Company from time to time (collectively known as “Services”).
1.4 Your (“you”, “your” or “user”) use of the Application is subject to these Terms and Conditions (“Terms”).
1.5 Your use of the Application on the Device requires that you agree to these Terms and the privacy policy available at https://www.jio.com/en-in/myjio-privacy-policy. By downloading the Application and by registering or signing up to the Application, or otherwise having access to, receiving, and/or using the Application, you acknowledge to have read, understood and you consent to be governed and bound by these Terms and the privacy policy of the Application. If you do not understand the Terms or the privacy policy of the Application, or do not accept any part of them, then you should not use the Application.
1.6 The Terms are an electronic record in terms of the Information Technology Act, 2000 (as amended / re-enacted) (“IT Act") and rules thereunder, and is published in accordance with the provisions of Rule 3 (1) of the of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of Application. This electronic record is generated by a computer system and does not require any physical or digital signatures.

2. PRIVACY AND PROTECTION OF PERSONAL INFORMATION:

2.1. Please refer to the privacy policy available at https://www.jio.com/en-in/myjio-privacy-policy.

3. REGISTRATION AND ACCESS TO THE APPLICATION

3.1. Download MyJio from the iOS App store and/or Play store. Please note, downloading the Platform is free of cost, however data charges may apply. For further details please contact your telecom operator.
3.2. Register on the Platform with a valid mobile number provided by a telecommunication service provider in India (for Non-Jio subscriber- input mobile number and OTP sent on the number provided). Please note that Non-Jio subscribers will not be allowed to proceed without confirmation of their mobile number. Please note that we will be able to get in touch with you, if needed, only if the mobile number you have input is registered with the service provider in India.
3.3. Click on “Fun Zone” icon available in the footer on “JioEngage” homepage under “JioEngage” Tab of the Platform.
3.4. Provide confirmation with regards to the name, age, gender, city, citizenship and acceptance of terms and conditions.
3.5. In the event the User uses a SIM card not registered in their name for registration, the Company will not be responsible to track such User.
3.6. In the event it is not possible to determine with certainty the User who registered from a particular mobile number, that entry would be disqualified. User(s) are requested to use phone numbers which are unique to them.
3.7. Taking part in the registration process shall be deemed to be acceptance by the User to receive promotional messages from the Company or any third party so authorized by the Company.
3.8. The procedures for registration on the Platform and use of Application are subject to the Terms and Conditions stated herein. Non-conformance by any User(s) to the Terms and Conditions will disqualify such User from using Services or Winnings, immediately, as the case may be.
3.9. You are entirely responsible for any and all activities that occur under your account. You agree to notify the Company of any unauthorized use of your account or any breach of security.

4. CHARGES FOR THE APPLICATION AND PLATFORM

4.1. The Application is free of cost, however data charges may apply. For further details User may contact their respective telecom operator.
4.2. User(s) to check with their respective telecom operator for any other applicable charges. In case any User registers while roaming in a different circle/zone/country, additional roaming rates may apply. User(s) to contact their respective telecom operator for the applicable rates.

5. GENERAL RULES

5.1 Services will be available from 10 AM to 9 PM every day or at such other time period as may be determined by the Company from time to time.
5.2 Where the Application or the ability of a User to use the Services is affected by any other network / technical / phone issues, the User will be permitted to re-use the Application.
5.3 The Company will not entertain any claims / questions / queries with respect to the Services or Application.
5.4 The cellular number from which the registration is received will be used to identify the User as a unique identification number. We urge Users to use the same cellular number used for the registration where they would be clearly identified as the User of the Application.
5.5 Any entry for use of the Application is not transferrable.
5.6 The Company may, at its discretion, contact the User(s), if required, for any clarifications needed for the information provided and User will provide the requisite information.
5.7 The Company has the right at any time to require proof of identity and/or eligibility from User. The Company may, at its discretion, contact the User(s), if required, for any clarifications needed for the information provided by the User and User will provide the requisite information.
5.8 The failure to provide proof or affidavit of eligibility, including the valid identity proof/ proof of name, address and correct date of birth within the time as stipulated in the Terms and Conditions or upon request by the Company may result in disqualification. The Company reserves the right to disqualify any User(s) from using the Application at its sole discretion, should the User(s) at any stage supply untruthful, inaccurate or misleading personal details and/or information.
5.9 All personal details and information requested by and supplied to the Company by each User must be truthful, accurate and in no way misleading.

6. WINNERS AND PRIZES

6.1 The Company may, at its discretion, decide to choose a user as a winner, as the company deems fit basis the scores on select Services, including but not limited to (i) daily challenges; (ii) polls and votes (iii) trivia quiz; or (iv) skill based games and engagements and/or (v) any other Services as may be decided by the company from time to time (collectively referred as “Engagements”) with the help of a randomizing software developed specially for choosing winners (“Winner”).
6.2 The randomizing software will use an appropriate method of choosing the Winner(s), at the discretion of the Company. In the event of a software failure, or for any other reason, the Company may adopt any other methodology or criteria at its sole discretion to select from amongst the users, depending upon requirement and availability.
6.3 A Winner shall be entitled to prizes as referred in Annexure B (“Prizes”).
6.4 The Company may decide to choose any number of Winner(s) at any given point of time and Prize(s) so won shall be announced by the Company at its sole discretion.
6.5 The Participant acknowledges and agrees that the Company reserves a right to add or modify the number of Prize(s) or withdraw the Prize(s) distributed as a part of the Contest.
6.6 The Company reserves the right, at its discretion, to institute one or more Prize(s) and the terms and conditions attendant thereto. Every Engagement(s) may not have Prize(s).
6.7 The Company’s decision on the validity of any answer submitted by the User while participating in the Engagements is final and binding on all User(s).
6.8 Results maintained by the Company or any official score keeper as appointed by the Company from time to time will be considered as final.
6.9 The Company will rely upon only such contact information as may be provided by the user at the time of registration on the Application to contact him/her.
6.10 Where the Winner(s) cannot be contacted telephonically; or (ii) after being so contacted (maximum of 3 (three) attempts), the Winner(s) does not claim the Prize with sufficient proof of identification as such Winner(s), the Prize for such Winner(s) stands forfeited. No further claims by the original winner who could not be contacted or does not claim the Prize, will be entertained and the Company will not be responsible or liable in any way whatsoever to such persons.
6.11 Notwithstanding the foregoing, the Company reserves the rights to determine and/or announce the timelines and the methodology of determining winners from time to time. The Company reserves the right to offer or withdraw any of the Prize(s) as provided herein-under, at any point of time, including after they have been announced.
6.12 The Prize(s) details will be available to the user in the ‘Winnings’ section of JioEngage Homepage on MyJio application. Details such as gratification partner / sponsor name and details of how to redeem the Prize may be made available in ‘Winnings’ section. Wherever applicable, on selecting the coupons in the ‘Winnings’ section, the user will be redirected to MyJio for redemption of the coupon.
6.13 The delivery of any Prize(s), including the terms and conditions applicable thereto, shall be determined by the relevant sponsor thereof. Neither the Company nor the sponsor will be responsible should the Winner(s) refuse to accept and/or be unavailable or incapacitated in any manner whatsoever to accept the Prize(s) as made available.
6.14 The Company will have no liability to a User who is unable to participate in the Engagements for whatever reason and the Company shall be entitled to disqualify the User at any time, at the discretion of the Company.
6.15 If at any point it is determined by the Company that any person has tampered with MyJio, the Engagements, or any data / servers / database / etc. related to the Engagements, the Company reserves the right at its discretion to revoke or cancel points or Winnings of any such User and / or initiate litigation as deemed fit and necessary by the Company.
6.16 Any and all taxes and/or levies applicable on the Prize(s) won by the Winner(s) under the laws of India shall be borne by the Winner(s) and/or relevant sponsors in relation to the relevant Prize(s). The Prize(s) to the Winner(s) shall be subject to deduction of all applicable taxes and levies and subject to the relevant Winner(s) providing the relevant documents as may be prescribed by the Company and/or relevant sponsor and subject to the Winner’s adherence to the applicable conditions, including special conditions, for the purposes of availing the Prize(s).
6.17 Where any Prize(s) involves a trip to any destination, the travel dates confirmed by the Company will be final and no changes to the same will be accepted. If the Winner or the companion is not available for the confirmed dates, then the Winner will be disqualified and the Prize(s) will be forfeited. The Winner will be required to send attested copies of a valid passport for the User and his/ her companion, PAN card of the User and any other documents that will be required to arrange for the User’s and companions’ visa within the stipulated time.
6.18 The Winner agrees that the delivery of his/her relevant Prize(s) may be delayed as a result of a delay in submission of documents and/ or any force majeure events which are not within the control of the Company.
6.19 The Winner hereby agrees that he/ she shall not hold the Company responsible for any delays and/ or disputes and/or claims arising out of any Prize(s) that such Winner may be entitled to, and shall indemnify the Company against any and all such claims.
6.20 The Winner hereby agree that any in case of any disputes/ claims arising out of any Prize(s), the same shall be addressed directly to the relevant sponsor of such Prize(s) and the Company shall not be held responsible for the same.
6.21 The Company may refuse to pay Wnnings or reclaim all sums paid to Winners in the event of any fraud, dishonesty or non-entitlement on the part of any of such Winner(s) to participate in the Engagements under the Terms and Conditions.

7. SPECIAL CONDITIONS FOR PRIZES

7.1 With respect to the Prizes, the special conditions applicable, if any, as notified by the relevant sponsor to the Company, is provided in Annexure C hereto. The Company shall make reasonable endeavours to communicate at Annexure C, such special conditions as may be notified to it by the relevant sponsors from time to time. However, the Company does not guarantee or assure the completeness and accuracy of such special conditions, including any updation or revision thereof from time to time and it shall be the sole responsibility of the relevant Winner(s) to ascertain all conditions pertaining to the Prize won by such Winner directly with the relevant sponsor.
7.2 The Company shall not be, in any manner, responsible for any decision taken by a Winner to avail any Prize and any consequences arising from the conditions that may be imposed by the relevant sponsors upon such Winner(s).
7.3 In the case of any conflict between any of the special conditions laid out in Annexure C and these Terms and Conditions, the latter shall take precedence and prevail.

8. PROMOTIONAL ACTIVITIES
8.1 The Company may, at its sole discretion, promote any products and/or services of its sponsors or third parties during the Engagements (“Promotional Activities”). For such Promotional Activities, the Company may provide any Participant with any goods and/or services and/or merchandise (“Promotional Materials”).
8.2 The Promotional Materials may be provided by the Company at any time during the Engagements.
8.3 The User agrees that any footage or any photographs of any nature of the Promotional Activities shall vest with the Company, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
8.4 The Users who are provided with the Promotional Materials agree that they shall co-operate with the Company and participate in any activity and/or campaign of any nature whatsoever without any money payable to such Participants.

9. MODIFICATIONS:

9.1 Modifications of the Terms: The Company reserves the right to change the Terms under which the Services are offered, including but not limited to the charges, if any, associated with the use of the Services. The Terms may be further modified based on changes in the business, legal and regulatory requirements and will be updated online. We will make all efforts to communicate any significant changes to these Terms to you. You are encouraged to periodically visit this page to review these Terms and any changes to it.
9.2 Modification of Services: The Company reserves the right to add, modify or delete any content or features available in the Services at any time at its sole discretion.

10. LINKS TO THIRD PARTY SITES AND APPLICATIONS:

10.1 The Application may contain links to other web sites/applications ("Linked Sites"). The Linked Sites are not under the control of the Company and the Company is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site or any information transmitted on a Linked Site. The inclusion of any link does not imply endorsement by the Company of the site or any association with its operators.
10.2 Any dealings with third parties (including advertisers) included within or available via a link from the Application or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. The Company shall not be responsible or liable for any part of any such dealings or promotions.
10.3 You acknowledge and agree that the use of any Linked Sites is governed by such third party’s terms of use, license agreement, privacy policy, or other such agreement. THE COMPANY DISCLAIMS ANY AND ALL RESPONSIBILITY FOR ANY DISCLOSURE OF INFORMATION OR ANY OTHER PRACTICES OF ANY THIRD PARTY. THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY WITH RESPECT TO YOUR PERSONAL OR OTHER INFORMATION THAT MAY BE COLLECTED, PROCESSED, SHARED OR RETAINED BY ANY THIRD PARTY.

11. INTELLECTUAL PROPERTY RIGHTS

11.1 The Company shall own title, interest and rights, including all related intellectual property rights, in/of the Application and/or your Device including but not limited to object code of the Application, features of services, which is/are protected by the applicable laws except the content owned by the user. You acknowledge that such ownership shall include all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether in the course of use of the Application, your Device or otherwise.
11.2 All materials provided on this Application, including but not limited to all information, materials, functions text, logos, designs, graphics, images, sounds, software, documents, products and services (collectively, the "Materials"), and the selection, arrangement and display thereof, are the copyrighted works of the Company/or its vendors or suppliers.

12. USE LIMITATIONS:

12.1 The Application is merely intended as a means for infotainment and gaming for users.
12.2 As a condition of your use of the Application, you warrant to the Company that you will not use the Application for any purpose that is unlawful or prohibited by these Terms. You may not use the Application in any manner which could damage, disable, overburden or impair the Services or interfere with any other party's use and enjoyment of the Application.
12.3 You are not entitled to use any kind of measures, mechanisms or tools (software or hardware) that could interfere with the functioning of the Application or any of its Services.
12.4 You may not use the Services and/or Application if (i) you have been convicted of any offence under applicable law; and/or (ii) if you are under the age of 18 years.

13. GENERAL

13.1 Use Restriction: You must not access the Application if you are a person who is either barred or otherwise legally prohibited from receiving or using the Service or any Services under the laws of India.
13.2 Third-Party Fees: You may incur access or data fees from third parties (such as your internet provider or mobile carrier) in connection with your use of Services and of Application. You are solely responsible for all such fees.
13.3 Updates: You may need to install updates to the Application or related software that we introduce from time to time to use of the Application. Services originating from the Application may communicate with the servers from time to time to check for available updates to the Services and to the functionality of the Application, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, "Updates"). Your use of the Services you have installed requires that you have agreed to receive such automatically requested Updates.
13.4 Accuracy of Information: You agree that the information entered by you while profile creation/updation or using any of Services is true, current, complete and accurate in all respects. The Company is not responsible for any losses arising out of discrepancy in your data. You are solely responsible for maintaining confidentiality and security of your user account and for all activities that occur on or through your user account. The Company is not responsible for any losses arising out of the unauthorized use of your user account.

14. LIMITATION OF LIABILITY:

14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF, OR INABILITY TO USE OR ACCESS, THE APPLICATION OR FOR ANY SECURITY BREACH OR ANY VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT, OR TECHNICAL MALFUNCTIONING OF THE APPLICATION, WHETHER OR NOT FORESEEABLE OR WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR BASED ON ANY THEORY OF LIABILITY, INCLUDING BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT, OF OR IN CONNECTION WITH, YOUR USE OF, OR ACCESS TO, THE APPLICATION OR THE CONTENT. FURTHER, THE COMPANY SHALL NOT BE LIABLE TO YOU FOR ANY TEMPORARY DISABLEMENT, PERMANENT DISCONTINUANCE OR MODIFICATION OF THE APPLICATION BY THE COMPANY OR FOR ANY CONSEQUENCES RESULTING FROM SUCH ACTIONS.

14.2 YOU SHALL BE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND ANCILLARY SERVICES (INCLUDING THE PAYMENT OF ANY ADDITIONAL FEES THEREFORE) REQUIRED TO CONNECT TO, ACCESS OR OTHERWISE USE THE SERVICES, INCLUDING, WITHOUT LIMITATION, VIDEO-ENABLED DEVICES, VIDEO COMMUNICATION SERVICES, MODEMS, HARDWARE, SERVERS, SOFTWARE, OPERATING SYSTEMS, NETWORKING, WEB SERVERS, INTERNET AND TELEPHONE SERVICE (COLLECTIVELY, “EQUIPMENT”). YOU WILL ALSO BE RESPONSIBLE FOR MAINTAINING THE SECURITY OF THE EQUIPMENT AND FOR ALL USES OF THE EQUIPMENT WITH OR WITHOUT YOUR KNOWLEDGE OR CONSENT.
14.3 YOU ARE SOLELY RESPONSIBLE FOR THE CONTENT AND OTHER MATERIALS YOU TRANSMIT THROUGH THE SERVICE OR SHARE WITH OTHER USERS OR RECIPIENTS. YOU WILL NOT TRANSMIT ANY CONTENT THAT YOU DID NOT CREATE OR THAT YOU DO NOT OWN ALL RIGHT, TITLE AND INTEREST IN AND TO, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHT AND RIGHTS OF PUBLICITY CONTAINED THEREIN.
14.4 THE COMPANY AND/OR ITS RESPECTIVE AFFILIATES MAKES NO REPRESENTATIONS ABOUT COMPATIBILITY, SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS AND ACCURACY OF THE INFORMATION, SOFTWARE AND SERVICES CONTAINED ON THE APPLICATION FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
14.5 YOU SPECIFICALLY AGREE THAT THE COMPANY SHALL NOT BE RESPONSIBLE FOR UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH THE APPLICATION. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL SERVICES OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT THE COMPANY IS NOT RESPONSIBLE FOR ANY SERVICES SENT USING AND/OR INCLUDED IN THE APPLICATION BY ANY THIRD PARTY.
14.6 IN NO EVENT SHALL THE COMPANY AND/OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR OR IN RELATION TO: (A) LOSS OF USE, DATA OR PROFITS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF APPLICATION; (B) ANY DELAY OR INABILITY TO USE THE APPLICATION OR SERVICES; (C) THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION OR SERVICES OBTAINED THROUGH THE APPLICATION; (D) OR OTHERWISE ARISING OUT OF THE USE OF THE APPLICATION OR THE SERVICES OF THE COMPANY; WHETHER OR NOT ALL OF THE ABOVE LOSSES, CLAIMS OR DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, EVEN IF THE COMPANY AND/OR ITS AFFILIATES AND/OR ITS ASSOCIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES, CLAIMS OR DAMAGES.

15. TERMINATION (TEMPORARY AND PERMANENT DISABLEMENT):

15.1 Unless otherwise provided in these Terms, the Services offered to you may be terminated by the Company without assigning any reasons at any time at the sole discretion of the Company. Upon termination / suspension, you shall not have the right to use or access the Application/Services.

16. GOVERNING LAW AND DISPUTE RESOLUTION:

16.1 These terms and conditions are governed and construed in accordance with the laws of India. The courts in Mumbai shall have exclusive jurisdiction to hear disputes arising out of these terms.

17. FORCE MAJEURE:

17.1 The Company shall be under no liability whatsoever in the event of non-availability of any portion of the Application or subscribed content occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, man-made disaster, infrastructure failure or any other cause whatsoever beyond the control of the Company.

18. SEVERABILITY:

18.1 If any of the provisions of these Terms are deemed invalid, void, or for any reason unenforceable, that part of these Terms will be deemed severable and will not affect the validity and enforceability of any remaining provisions of these Terms.
